The Constitutional Court has upheld the appeal by the national government of unconstitutionality contained in certain articles of the Balearic Trade Act. The government has argued that these invade powers of the state and its decision to challenge the regional legislation has sparked off a colossal row, with all political parties in the Balearics united against the government.
The court has agreed to a suspension of the act’s articles that are being challenged and it has five months to either ratify their unconstitutional nature or to lift the suspension.
The Balearic Government, meantime, has fifteen days with which to prepare before representatives appear in person at the court.
