The Gelats Valls business went into receivership in June.
The Gelats Valls kiosk by the Plaça Major in Pollensa town is to be dismantled.
The Gelats Valls ice-cream kiosk was dismantled almost a year ago.
It was alleged by the complainants that the town hall had favoured the Valls ice-cream business.
Pollensa town hall is looking into whether the Valls family can continue with this kiosk with all guarantees.
The current mayor and his predecessor are being investigated because of claims that they allowed the ice-cream kiosk to continue operating.
There was confusion over flood aid; olive ebola began to look deadly serious; the transport ministry had designs on central reservations and continued to lock horns with taxi drivers; town halls were being insulted; and they were crying over an ice-cream kiosk.
Mayor March made clear that there is no plan to authorise an expansion of the cafe's terrace and to so occupy part of the space left by the kiosk.
It had been understood there was to be a tender for the kiosk in the current location.
At four this afternoon, there will be free ice-cream at the Gelats Valls ice-cream kiosk.
The mayor, Miquel Angel March, has been facing a charge of malfeasance in relation to the Gelats Vall kiosk.
The complainant alleges that the town hall has favoured Gelats Valls in "an obvious and direct way that is detrimental to third parties and to the public interest".
There is an allegation of malfeasance in having allowed the kiosk to remain open and not evicting the current owners.
